These Terms and Conditions ("Terms") govern your use of the Dubai Desert Adventures website and services. By accessing our website, making a booking, or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

1. Definitions

In these Terms:

• "Company," "we," "us," or "our" refers to Dubai Desert Adventures, registration number 74029035.
• "Customer," "you," or "your" refers to any individual or entity that accesses our website or books our services.
• "Services" refers to desert safaris, tours, activities, and related services offered by Dubai Desert Adventures.
• "Website" refers to the domain dubaidesertadventures.com and all its subdomains.
• "Booking" refers to a reservation for any service offered by Dubai Desert Adventures.

2. Bookings and Payments

2.1 Booking Process

Bookings can be made through our website, via email, by phone, or through authorized travel agents. A booking is confirmed once you have received a confirmation email or document from us and made the required payment.

2.2 Payment Terms

The following payment terms apply:

• A deposit of 25% of the total booking amount is required at the time of booking.
• Full payment is due at least 7 days before the scheduled service date.
• For bookings made within 7 days of the service date, full payment is required at the time of booking.
• We accept payments by credit card, debit card, bank transfer, and other methods specified on our website.
• All prices are quoted in United Arab Emirates Dirham (AED) unless otherwise specified.

2.3 Price and Taxes

All prices are inclusive of applicable taxes, including Value Added Tax (VAT). We reserve the right to change our prices at any time, but changes will not affect bookings already confirmed.

3. Cancellations and Refunds

3.1 Cancellation by Customer

The following cancellation policy applies to bookings cancelled by customers:

• Cancellations made 7 or more days before the scheduled service date: full refund minus administrative fee (5% of the total booking amount).
• Cancellations made 3-6 days before the scheduled service date: 50% refund.
• Cancellations made within 48 hours of the scheduled service date: no refund.
• No-shows will be charged the full amount of the booking.

All cancellations must be made in writing (email or letter) to be valid.

3.2 Cancellation by Company

We reserve the right to cancel or modify a service due to weather conditions, insufficient participants, or circumstances beyond our control that may compromise safety or quality.

If we cancel a service, you will be offered one of the following options:

• Full refund of the amount paid
• Rescheduling to an alternative date without additional charge
• Alternative service of equivalent value

We are not liable for any additional expenses incurred as a result of our cancellations, such as accommodation, transportation, or other third-party services.

3.3 Refund Processing

Refunds will be processed within 14 business days of the cancellation being accepted. Refunds will be issued using the same method of payment used for the original transaction unless otherwise agreed.

4. Service Terms and Conditions

4.1 Schedule and Itinerary

We will make every effort to adhere to the advertised itineraries and timings. However, we reserve the right to modify the itinerary or schedule due to weather, traffic, or other operational considerations. Such changes do not entitle customers to a refund.

4.2 Pickup and Drop-off

For services that include transportation:

• We provide pickup and drop-off at most hotels and residences within Dubai city limits.
• You must be ready at the designated pickup point at the scheduled time.
• If you are not present at the scheduled pickup time, we will wait for a maximum of 15 minutes, after which we will depart, and no refund will be provided.
• For pickups from locations outside Dubai city limits, additional charges may apply.

4.3 Health and Safety

For your safety and the safety of others:

• You must follow all safety instructions provided by our staff during activities.
• You must inform us at the time of booking of any medical conditions, allergies, or disabilities that may affect your participation in activities.
• We reserve the right to refuse service to anyone who appears to be under the influence of alcohol or drugs, or whose behavior may endanger themselves or others.
• Pregnant women, individuals with heart conditions, back problems, or other serious medical conditions may not be permitted to participate in certain activities.
• Children under 18 must be accompanied by an adult.

4.4 Belongings and Liability

You are responsible for your personal belongings during the service. We are not liable for any loss, damage, or theft of personal items, unless caused directly by our negligence.

5. Intellectual Property

All content on our website, including text, graphics, logos, images, audio, video, and software, is the property of Dubai Desert Adventures or our content suppliers and is protected by international copyright laws.

You may not reproduce, modify, distribute, or republish any content from our website without our prior written consent.

6. Photography and Promotional Use

During our services, photographs or videos may be taken by our staff for promotional purposes. By participating in our services, you grant us permission to use any images or videos in which you appear for marketing, social media, and promotional materials without compensation.

If you prefer not to be photographed or filmed, please inform our staff at the beginning of the service.

7. User Content

If you submit reviews, comments, or other content to our website or social media platforms:

• You grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, and publish such content.
• You warrant that the content is your original work, does not infringe on any third party's rights, and is not defamatory, offensive, or otherwise illegal.
• We reserve the right to remove or edit any content at our discretion.

8. Limitation of Liability

To the fullest extent permitted by law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
• Our total liability for any claim arising from or related to our services shall not exceed the total amount paid by you for the service in question.
• We are not liable for any failure to perform our obligations due to events beyond our reasonable control, including but not limited to natural disasters, acts of government, terrorism, civil unrest, or failure of third-party suppliers.

9. Indemnification

You agree to indemnify, defend, and hold harmless Dubai Desert Adventures, its officers, directors, employees, agents, and suppliers from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your violation of these Terms
• Your use of our services
• Your violation of any rights of a third party
• Your conduct in connection with our services

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

11. Amendments to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our website or services following the posting of revised Terms constitutes your acceptance of such changes.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions.
